When a trust is created, the creator (known as the settlor) may wish to appoint a ‘protector’ to oversee the activities of the trustee by using certain independent powers as part of the governance of the trust. In the case of a foundation, a parallel role may be performed by an ‘enforcer’. Traditionally, these roles have been offered to close confidantes of the settlor and his or her family, but increasing global personal information disclosure requirements mean that a professional corporate protector is now often chosen by families instead.
